Product Liability

Each year thousands of consumers are seriously injured or killed by dangerous and defective products. In many instances these accidents could have been avoided if the manufacturers or distributors of these products took additional steps to ensure consumer safety. These products may include:

  • Dangerous toys
  • Industrial machinery and equipment
  • Improperly designedconsumer products
  • Automobiles
  • Pharmaceutical drugs

 

Florida law protects consumers and workers from these types of products by permitting them to sue the manufacturer or other entity responsible for the defective product or machinery and receive compensation for their injuries. When someone has been injured while using a product, even if human error is partially to blame, they may still be entitled to monetary compensation for their injuries. For example, manufactures must take into consideration common human error and the appliance or machine must be designed to provide safeguards against foreseeable misuses of the product. Additionally, the product must be labeled with sufficient instructions or warnings detailing necessary precautions the consumer must take.
